If you think you have suffered a work injury, you need to report the
injury to your employer. If they do not care for you, you are should get a
lawyer. The cost of the lawyer is paid by your workers’ compensation
insurance. Your employer cannot discriminate against you for reporting an
injury or seeing a lawyer.
The State Constitution of California guarantees you all the care needed
to cure or relieve you from the effects of a work injury. Recent changes
to the law have decreased benefits for injured workers. Retraining, for
example, has been eliminated. The Governor is working with insurance
companies to introduce legislation and a proposition which may eliminate
many other benefits.
Governor Schwarzenegger’s new laws would take away your right to choose
a doctor. His proposal would allow insurance companies to direct your
care. His legislation won’t solve the high cost of workers’ compensation
insurance. Insurance companies would not be required to pass on savings to
employers
If you are an employee, and especially if you do dangerous work, you
need to protect your rights now. You need to talk to your union
representatives. You may want to write to your legislator. You should vote
against any November ballot initiatives which limit benefits to injured
workers. See www.CAAA.com,
the applicant attorney’s web site, for more information. |
